Abstract
Background. Modern biomedicine is rapidly developing all over the world. The changes that are taking place determine new approaches to regulating individual issues of public health. This thesis is also applicable to Russian legislation, the transformation of which is impossible without taking into account foreign experience. The main objective is to define the legal basis for regulating public relations in the field of biomedicine, relying on foreign experience. The French legal system is chosen as an illustrative example. Materials and methods. The empirical basis of the study was formed by the normative acts of France, namely the Laws on Bioethics, as well as other legal sources that determine approaches to regulating biomedical technologies. In connection with the comparative focus of the study, the main method is comparative legal, which allowed us to project foreign experience onto Russian legal reality. Results. The article presents a general description of the French legislation in the field of biomedicine. The dynamics of the adoption of laws on bioethics are shown, the main provisions of the said laws in the field of transplantology, reproductive medicine, genomic medicine are disclosed. The experience of the functioning of the National Advisory Ethics Committee for Life and Health Sciences is considered. Recommendations for improving Russian legislation are presented. Conclusions. France became the first country to clearly introduce the concept of bioethics into legal circulation, using it in the title of an official law. The key provisions of legislative acts in the field of biomedicine are highlighted, which can be used to improve the Russian legal system. Attention is drawn to the block of legal norms devoted to genomic medicine and reproductive medicine.
